7. Applicable law and relevant laws.

Subject to French law, the website is governed by law no. 2004-2005 of June 21, 2004 for confidence in the digital economy, article L.335-2 of the Intellectual Property Code and the “IT” law. and freedoms” of January 6, 1978 amended in 2004.

Valphotovar General Conditions of Sale:

1 – Photo sessions are carried out outdoors (location to be determined together), at the client's home or workplace (for professionals).

2 – Full payment must be made upon signing the contract. For weddings, a deposit equivalent to 30% of the amount must be paid when signing the contract. The balance must be paid in 2 or 3 installments, final payment no later than one week before the wedding.

3 – A sample of photos may be put on the blog of: www.valphotovar.com in low definition and with the Valphotovar logo as protection, with a link on social networks, with the client's agreement.

4 – The photos taken are posted online on a private and secure gallery with access code and password, which Valphotovar will transmit to the client.

5 – All services are à la carte (photography and media offered).

6 – Images are processed (retouched and optimized) within 3 weeks maximum.

7 – Regarding the design of books, it is personalized and subject to customer agreement before printing. Delivered within approximately two months from the date of choice of photos, excluding possible technical problems.

8 – Gift vouchers are payable in advance and sent by mail or delivered in person. The name, email and telephone number of the beneficiary must be sent to Valphotovar in person or by post with payment of the gift voucher.

7 – The placing of an order by the customer implies unreserved acceptance of these general conditions of sale, except for special conditions stipulated in writing by the photographer to the customer. Any document other than these general conditions of sale and in particular prospectus and Advertisements have only informative and indicative value, not contractual.

8 – These general conditions of sale form an indivisible contractual document with the purchase order and the price list attached. Once the contract is signed, the parties will no longer be able to opt for another formula, unless agreed by the photographer, in accordance with article 1109 of the civil code.

9 – Delivery of photographic media after validation by the customer for printing will be made to the customer's home unless otherwise agreed between the two parties. Valphotovar undertakes to deliver to the customer within 20 to 40 days depending on the type of support.

The media may (only if the customer does not reside in the Var or neighboring department) be sent at the declared value, at the customer's request, at his own expense and after full payment of the invoice which will include said costs.

Valphotovar advises against postal delivery in all cases and cannot be held responsible for defects due to transport and poor handling of the package.
Despite everything, Valphotovar undertakes to provide substantial packaging in order to best guarantee its shipment.

10 - Weather conditions: In the event of force majeure during an outdoor session (bad weather conditions, bad weather, thunderstorm, storm, etc.) the photographer reserves the right to propose modifications (if possible) to the conditions of execution of the session. the service provided for on the order form (location, time, day, etc.).

10 - Intellectual property: The photographs are the property of the photographer. Any use of a photograph, whatever it may be and whatever its purpose: reproduction for commercial or political purposes, representation, and more generally, the possibility of diverting them from their purely private purpose.
Any possible extension of rights must be subject to prior authorization from the photographer. Use made without the prior written consent of the photographer constitutes an offense of counterfeiting.

If the photographer agrees, it gives rise to an agreement which includes payment of usage rights. The customer will be held responsible for any violation of this prohibition.
The photographer owns the digital files and all digital media created by herself.

11 - Any question relating to these general conditions of sale is governed by French law. The competent court is the court of seate social media of the photographer.

12 - The contractual relations between parties to which these general conditions apply are governed exclusively by French law.

In the event of a dispute relating to the formation, execution or interpretation of these general conditions as well as any agreements to which they apply, the parties undertake to seek as a priority an amicable agreement before any action in justice.

Any complaint must be made by registered letter with acknowledgment of receipt within 5 days of service or delivery of the product in question, public holidays included, postmark as proof.

If the Customer considers that he has not obtained a satisfactory response from Valphotovar to his complaint (or no response) beyond 2 months, he may contact C&C-médiation, an entity designated as “referent mediator”.

In the event of an unresolved dispute, the consumer mediator can be contacted at the following addresses:

Please note: The customer must prove that they have already contacted Valphotovar for their complaint - previously and in writing. If the customer's request is declared admissible, the mediator will then handle the dispute (complaints less than 12 months old)

If necessary, the parties will retain all rights to refer the matter to the competent court.

Customers acknowledge having read the general conditions of sale above.
The parties expressly agree that the photographs will not be delivered in the absence of payment of the balance of the agreed price.

Signing a reservation materialized by this contract implies full acceptance of its content. No contrary condition may be invoked against the Photographer without the latter's prior written consent. Any modification will result in the signing of an amendment or a handwritten addition to this contract, which addition should be signed by both parties.
